PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE SERVICES PROVIDED BY STERLING LAWYERS LTD.

Welcome to CaseCraft.AI These Terms and Conditions (“Terms”) are a legally binding agreement between you (“you”, “the user”, or “customer”) and STERLING LAWYERS LTD a company incorporated in England and Wales with company number 09711065 and its registered office at Temple Chambers, 3-7 Temple Avenue, London, England, EC4Y 0DT and regulated by the Solicitor Regulation Authority with under Solicitor Regulation Authority number 630147, trading as CaseCraft (“CaseCraft”, “we”, “us”, or “our”). By using our website, platform, or any of our services made available through https://casecraft.ai/ (the “Website”), you agree to be bound by these Terms, as well as our Privacy Policy available on our Website at https://casecraft.ai/privacy-policy/.

At any time, CaseCraft.AI may change these Terms by updating this posting, or emailing you at the email address you provided. You should visit this posting to review these Terms from time to time. In these Terms, references to CaseCraft.AI include its parents, affiliates, directors and employees.


About Us

CaseCraft.AI operates the website which provides a legal technology interface supported by regulated legal professionals to assist individuals in preparing, issuing, and managing small claims matters in England and Wales.

Agreement between you and CaseCraft

You must be at least 18 years of age and have legal capacity to enter into a binding contract under UK law. You must provide accurate, complete, and current information and keep it up to date.

These Terms govern any use of the Website as a guest, fee paying member or otherwise.

You are responsible for making all arrangements necessary for you to have access to the Website and for ensuring any contact details you provide us with are correct and up to date. You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms and that they comply with them.

The Website is offered to you conditional upon your acceptance of these Terms and any notices contained in these Terms and the Website itself. Please read these Terms carefully before you start using the Website. By using the Website, you agree to these Terms.

Confidentiality

Law firms are under both a professional and legal obligation to keep the affairs of their clients strictly confidential.

This obligation, however is subject to statutory exceptions. Legislation on money-laundering and terrorist activities place solicitors under a legal duty in certain circumstances to disclose information about clients to the relevant authority.

Where CaseCraft.AI knows or suspects that a transaction on behalf of a client involves money-laundering, CaseCraft.AI may be required by law to make a money-laundering disclosure. If that happens, we may not be able to inform you that a disclosure has been made or the reasons for it because the law prevents “tipping off”.

Your matters with CaseCraft.AI are strictly confidential. However, there is a risk that documents transmitted to and from Website by fax and/or email may be read by unauthorised third parties.

Unless you instruct us to the contrary, in writing, we shall use both fax and email on the understanding that you are aware of, and accept, the possibility of third parties having unauthorised access to otherwise confidential documentation and information.

As part of our continuous quality audit procedures, your file may be selected for inspection at random by internal and external auditors. You may be assured of the confidentiality of the process.

Any communications between you and our legal professionals are protected by legal professional privilege where applicable under English law.

A solicitor-client relationship is only created where we expressly agree to act for you, and our duties will be governed by the rules and principles of the Solicitors Regulation Authority. Please note that we may only act for you to the extent that we accept your instructions. No ongoing legal retainer shall exist beyond the specific matter or service for which you have engaged us.

Professional Indemnity Insurance

As with all other legal firms, we hold in place Professional Indemnity cover. Our insurers are Travellers Insurance Company Limited whose address and contact details are set out on the Website together with the current policy number.

Rejecting our service

Sometimes we may reject providing services to you at our own discretion. When this happens, we let you know as soon as possible and refund any sums you have paid (if any).

Fees and Payment Terms

Onboarding Fee

You agree to pay a non-refundable onboarding fee of £15 upon creating an account or initiating any service with CaseCraft.AI. This fee grants you access to the platform and its features. You acknowledge and agree that this fee is earned upon payment and shall not be refundable under any circumstances, including failure to complete a claim or technical difficulties experienced by you or your device.

Court Fees

Where applicable, you authorise CaseCraft.AI to collect and process any court or tribunal filing fees on your behalf. These must be paid to CaseCraft.AI in advance and are passed through to the relevant body as part of the filing process. If you fail to provide the required court fee within the requested timeframe, CaseCraft.AI will not proceed with the filing or submission of any documents, and no liability will arise on our part for any missed deadlines or procedural consequences resulting from such failure.

Claimants

You acknowledge and agree that if you use the Website to prepare a claim and:

  • You receive a judgment or settlement award, you agree to pay CaseCraft.AI 10% of the total recovered sum (excluding interest or costs awarded).
  • You obtain a favourable order that cannot be enforced for any reason (e.g. defendant cannot pay), you agree that the 10% commission remains payable in full, regardless of recovery or enforcement.
  • This commission is payable immediately upon the issuance of the judgment or order, or upon settlement, whether or not funds are yet received by you.

You acknowledge and agree that if you use the Website or any CaseCraft.AI services to prepare, issue, or pursue a claim, you shall be liable to pay CaseCraft.AI a commission fee in the following circumstances:

  • Where your claim results in a financial award, judgment, settlement, or other enforceable order in your favour (whether by court decision, negotiated settlement, default judgment, admission, or any other legal process) you shall pay CaseCraft.AI a commission equal to 10% of the total amount awarded or agreed to be awarded to you;
  • Where your claim is successful on the merits but you are unable to enforce the outcome (including but not limited to cases where the defendant is insolvent, evades payment, or fails to respond), the 10% commission shall nevertheless remain fully payable and enforceable, and is not contingent upon actual recovery of funds; and
  • Where any part of the claim is settled, paid, or acknowledged by the defendant (whether formally or informally, before or after the issue of proceedings) you shall remain liable for the 10% commission on the value of such settlement, payment, or acknowledgment, regardless of whether the amount has been received in full, in part, or is payable in instalments.

You agree that CaseCraft.AI shall be entitled to raise an invoice for the applicable commission immediately upon whichever occurs first:

  • the date of judgment or order;
  • the date of any binding settlement or agreement; or
  • the date of a signed acceptance or acknowledgement of liability by the other party; or
  • if you fail to respond or engage in any further communication with us after receiving a Letter Before Claim prepared or submitted through our Website, within 45 days of its issuance, CaseCraft.AI shall be entitled to raise the invoice for the 10% commission on the basis that the claim has effectively concluded due to inaction.

Such commission shall be due and payable without delay, and shall not be subject to offset, deduction, or any conditional payment mechanism.

This clause survives termination of your account or cessation of your use of the Website and shall be enforceable regardless of whether CaseCraft.AI continued to assist you through to final resolution.

Defendants

You acknowledge and agree that if you use the Website or any CaseCraft.AI services in relation to defending a claim, you shall be liable to pay CaseCraft.AI a commission fee in the following circumstances:

  • If the claim is dismissed, withdrawn, discontinued, or otherwise successfully defended in full, whether by judgment, settlement, procedural order, or any other means, you shall pay CaseCraft.AI a fee equal to 10% of the total amount originally claimed against you; and
  • If the claim is partially defeated or reduced (whether by way of defence, counterclaim, settlement, admission, or judicial assessment), you shall pay CaseCraft.AI a fee equal to 10% of the full claim amount.

If you achieve a favourable outcome by negotiation, mediation, court order, or other dispute resolution method, whether before or after proceedings are issued, the above fees shall apply based on the value of the claim avoided or reduced as a result of CaseCraft.AI’s involvement.

This commission is payable immediately upon conclusion of the matter, including upon issuance of any court order, approval of any settlement, or confirmation of withdrawal or discontinuance of the claim, whichever occurs first.

This clause survives termination of your account or cessation of your use of the Website and shall be enforceable regardless of whether CaseCraft.AI continued to assist you through to final resolution.

Timing of Payments and Late Fees

All payments under these Terms are immediately due upon invoice. If payment is not received when due, CaseCraft.AI reserves the right to:

  • Charge statutory interest at a rate of 8% per annum above the Bank of England base rate, accruing daily;
  • Suspend or withhold access to the Website; and
  • Recover any outstanding sums owed to us via third-party debt collection agencies or legal action, in which case you shall be responsible for all reasonable enforcement costs incurred.

Cancellations and Refunds

Due to the instant nature of automated document generation of our service, you expressly acknowledge and agree that:

  • Once a document has been generated, or a service initiated, you expressly request us to begin performance of the service immediately and acknowledge that you lose your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;
  • The onboarding fee and all court fee prepayments are non-refundable;
  • Commission payments under the section “Fees and Payment Terms” of these Terms are due unconditionally upon occurrence of the applicable triggering event, and no refund shall be available in the event you later change your mind or are dissatisfied with the outcome.

You may cancel your CaseCraft.AI account at any time, but such cancellation shall not affect any accrued rights or outstanding payment obligations under these Terms.

Your CaseCraft Account

When you create an account on the Website (“CaseCraft.AI Account”), you agree that you will not use a username or email address for your CaseCraft.AI Account that belongs to someone else, impersonates someone else, violates another’s intellectual property rights, or is offensive in CaseCraft.AI’s discretion. You agree to provide true, current and complete registration information about yourself, and to update this information promptly when it changes or upon our request.

You are responsible for maintaining the security of your CaseCraft.AI Account and are responsible for all activities that occur under your CaseCraft.AI Account, whether or not you authorised the activity. You will immediately notify us of any unauthorised use of your CaseCraft.AI Account or any other breach of security.

You cannot sell, transfer, or assign your CaseCraft.AI Account to someone else without our express written consent.

You represent that any dispute or request submitted is an authentic problem you are having. You are responsible for any damages to CaseCraft.AI or others from disputes with fake or inauthentic information, or from reselling our services. Specifically, you must have a good faith basis for believing any piece of information or personal detail you provide to CaseCraft.AI. You may not use any part of our Website if you have been notified that you are not permitted to do so (“Ban Notification”). You may receive a Ban Notification through an automated CaseCraft.AI system, by email to the address on file or from a message from a CaseCraft.AI employee.

Any breach of the above may result in immediate suspension or termination of your CaseCraft.AI Account without refund, and CaseCraft.AI reserves the right to pursue any remedies available in law or equity.

Intellectual Property Rights

For the purposes of these Terms, “Intellectual Property Rights” means any and all intellectual property rights, whether registered or unregistered, including but not limited to any patents, trademarks, domain names, URLs, design rights, copyright, software rights, database rights, rights in and to business names, product names and logos, processes, trade secrets, confidential information and any similar rights in any jurisdiction.

CaseCraft.AI shall retain and be assigned all rights, title, interest and Intellectual Property Rights in relation to the legal forms, legal documents, letters, legal guides, articles and all other content and services found on the Website (the “Content”).

Except as otherwise provided in these Terms, you must not:

  • reproduce, modify, translate or create derivative works of any Content;
  • sell, license, sublicense, rent, lease, distribute, copy, publicly display, publish, adapt or edit any Content; or
  • circumvent or disable any security or technical features of the Content.

Data Privacy

Our use of your CaseCraft.AI Account, and all data and personal information provided by you is governed by our Privacy Policy available at https://casecraft.ai/privacy-policy/.

Liability

Nothing in these Terms limits or excludes our liability:

  • for death or personal injury caused by our negligence;
  • for fraud or fraudulent misrepresentation;
  • for any matter in respect of which it would be unlawful for us to exclude or limit liability;
  • under the Solicitors Regulation Authority Standards and Regulations (2019);
  • under the Consumer Rights Act 2015.

CaseCraft.AI maintains professional indemnity insurance in compliance with the SRA Indemnity Insurance Rules. Information regarding our current insurance provider and coverage can be provided on request.

Guest users

You use the Website at your own risk. Neither CaseCraft.AI nor any company within our group, and our and their respective agents, employees and subcontractors, shall be liable to you or any other party for any losses or damages whatsoever or howsoever arising in connection with the Website (whether under these Terms or other contract or as a result of any misrepresentation, misstatement or tortious act or omission, including negligence).

No unlawful or prohibited use

As a condition of your use of the Website, you will not use the Website for any purpose that is unlawful or prohibited by these Terms. You will not use the Website in any manner which could damage, disable, overburden or impair the Website, or interfere with any other party’s use and enjoyment of the Website. You will neither obtain nor attempt to obtain any materials or information through any means not intentionally provided for on the Website.

The Content is protected by copyright and all other applicable Intellectual Property Rights set out above. Content is for your personal use only and not for resale. Your use of the Website does not entitle you to resell any Content from the Website. For the avoidance of doubt, your use of the Website constitutes your acceptance of these Terms and your promise that you will not resell or otherwise attempt to commercially benefit from the Content without our written express consent.

Links to third party websites

Our Website may contain links to third party resources and businesses on the Internet, called here “links” or “Linked Sites.” Those links are provided for your convenience to help you identify and locate other Internet resources that may be of interest to you. CaseCraft does not sponsor and is not legally associated with any third party Linked Sites. CaseCraft.AI is not legally authorised to use any trade name, registered trademark, logo or copyrighted material that may appear in the link.

CaseCraft.AI does not control, endorse or monitor the contents of any Linked Site. That includes, without limitation, any further link contained in a Linked Site, and any changes or updates to a Linked Site. CaseCraft.AI is not responsible for webcasting or for any other form of transmission received from any Linked Site. These Terms do not cover your interaction with Linked Sites. You should carefully review the terms and conditions and privacy policies of any third party sites.

If you use any service provided on a Linked Site, (a) CaseCraft.AI will not be responsible for any act or omission of the third party, including the third party’s access to or use of your customer data and (b) CaseCraft.AI does not warrant or support any service provided by the third party.

We can change services and these Terms

We can always change a service:

  • to reflect changes in relevant laws and regulatory requirements; and
  • to make minor technical adjustments and improvements, for example to address a security threat. These are changes that don’t affect your use of the service.

Changes we can only make if we give you notice and an option to terminate.

We can also make the following types of change to the service or these terms, but if we do so we’ll notify you and you can then contact us via info@casecraft.ai to terminate these terms before the change takes effect and receive a refund for any services you’ve paid for in advance but not received.

We may adjust the prices of our fees and may allow you to terminate.

We contact you in advance to tell you we’re suspending services on our Website, unless the problem is urgent or an emergency. If we suspend the Website, or tell you we’re going to suspend supply, for more than 7 business days, you can contact us on info@casecraft.ai to terminate these terms and we’ll refund any sums you’ve paid in advance for services you won’t receive.

General

You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms or your use of the Website.

Our performance of these Terms is subject to existing laws and legal process. Nothing contained in these Terms is in derogation of our right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Website or information provided to or gathered by us with respect to such use.

If any part of these Terms is determined to be invalid or unenforceable under any applicable law, including, but not limited to, the warranty disclaimers and liability limitations set out above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms will continue in effect.

We may provide you with notices, including those regarding changes to the Terms by email, regular mail, postings on the Website, or other reasonable means now known or developed in the future.

A printed version of these Terms, and of any notice given in electronic form, will be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that these Terms and all related documents have been drawn up in English.

Modifications

We aim to update the Website regularly and can change the content at any time. We will use our reasonable efforts to keep the Website available to you, but if necessary, we may suspend access to the Website, or close it indefinitely. We will not be liable if for any reason the Website is unavailable at any time or for any period.

We may revise these Terms from time to time, and will always post the most current version on our Website. If a revision meaningfully reduces your rights, we will notify you (by, for example, posting on our blog or on this page). By continuing to use or access the Website after the revisions come into effect, you agree to be bound by the revised Terms.

Entire agreement

Unless otherwise specified, these Terms constitute the entire Terms between you and us with respect to the Website and it supersedes all prior communications and proposals, whether electronic, oral or written, between you and us with respect to the Website.

Assignment

You must not assign or otherwise transfer the Terms, or any right granted under them, without our written consent. We can freely transfer our rights under the Terms.

Waiver

Any failure by us to enforce or exercise any provision of the Terms, or any related right, will not be a waiver of that provision or right. Any rights not expressly granted in these Terms are reserved.

Third party rights

A person who is not a party to these Terms shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision in these Terms.

Applicable law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and interpreted in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Complaints

If you are unhappy with any aspect of our services, you are entitled to make a complaint. We have a formal complaints procedure and a copy of it will be made available to you on request.

At the conclusion of the complaints procedure, you have the right to complain to the Legal Ombudsman. The time period allowed for this for is 6 months from the date of our final decision letter.

Dmitry Bagrov

Technology oversight

Dmitry Bagrov led the establishment of DataArt UK and currently oversees all aspects of its operations, from sales to production and HR management.

In his time as a Managing Director, Dmitry has built DataArt UK into a fully-staffed provider of end-to-end solutions and has brought annual revenue from $2.4 million in 2009 to over $110 million in 2023. He has led teams to gain a range of clients, including Flutter, Apax Partners, Trainline, Coller Capital, Ocado Technology, British Gas, major UK banks and financial services firms.

With over thirty years’ experience across product and service development, delivery, sales and management, Dmitry’s 24 years with DataArt followed roles of project manager and developer in other companies.
